OFCCP Regulation Requires Additional Compensation Reporting from Federal Contractors

The Office of Federal Contract Compliance Programs (OFCCP) is proposing new reporting obligations for Federal contractors and subcontractors related to their employee compensation. The proposal would require all Federal contractors and subcontractors to provide, “summary information on compensation paid to employees…by sex, race, ethnicity, and specified job categories.” It also requires these companies to report, “other relevant data points such as hours worked, and the number of employees.” Information provided should match all W-2 Wage and Tax Statement forms submitted by the company. Information newly required under this proposal must be contained in the Employer Information Report, which is, “required to be filed with the U.S. Equal Employment Opportunity Commission.”

OFCCP believes this proposal will help eliminate compensation discrimination in three ways:

  1. Enables OFCCP to focus on those contractors and subcontractors whose reports, “suggest potential pay violations,” and not focus on, “entities for which there is no evidence of potential pay violations;”

  2. Encourages greater voluntary compliance from contractors and subcontractors; and

  3. Allows greater maintenance and deterrence of noncompliant behaviors by contractors and subcontractors.

While achieving these objectives, OFCCP hopes to minimize, “to the extent feasible, the compliance burden borne by Federal contractors and subcontractors.” Comments on this OFCCP regulation are due November 6, 2014.
